The 3 Stages of Debt Collection

It hasn’t been easy in this economy to pay off debt. Medical bills, the loss of a job, or simply not making enough money to service your debt can be devastating both financially and emotionally. Ideally, you should never take on any debt – paying for everything with cash is the ultimate in responsible living – but it’s fairly difficult to avoid some debt. Credit cards, student loans, home mortgages, and auto loans are four of the most common types of debt you are likely to incur. Whether you live in New York or Texas, debt collection processes are probably a part of your life.

The best way to pay off debt is to make enough money to pay it down quickly. There are a number of very effective debt payment programs that are free or inexpensive and simple to understand. You will need to be disciplined in order to get yourself debt-free, but the rewards of owing no one but yourself are indescribable. If you are in debt, begin researching these programs to find a system that best meshes with your lifestyle. Finding a second job to earn cash for debt repayment, moving to a less expensive home or apartment, cutting out non-necessities, and spending less than you earn are all things you can do.

If you fail to pay a debt, your creditor will most likely warn you that your account will be sent to a debt collection agency of some kind unless you make other arrangements. Many companies and businesses turn to third-party agencies to aid in the collection of debts, but it usually isn’t their first choice because your creditor won’t be able to keep all the money. Debt collection agencies are usually paid a percentage of the total amount owed if they can successfully collect on the debt. If you find yourself in a bind, immediately contact your creditor to explain the situation and see if an arrangement can be made. Sometimes the creditor will refinance or settle for less, but failing to do anything about it will probably lead to the third stage of debt collection.

If a debt collection agency ends up with your account, you’re going to hear about it. Debt collection agencies and companies don’t generally get paid unless they collect, so their motivation is to get you to pay up. Many of them will negotiate a payment schedule with you, and as long as you continue holding up your end of the bargain, you’ll be okay. If, however, you fail to make timely payments, you’re going to hear about it. Many states have laws protecting debtors from being harassed in specific ways by debt collectors, but within the law’s boundaries, they are within their rights to do what they can to get your money. If you cannot pay the debt, are getting harassed in illegal ways, or need some good advice, it might be a good time to consult an experienced lawyer.
